Kooloo offers this Website, including all information, tools, and services available from this site to you, the user, on the condition that you accept all the terms, conditions, policies, and notices stated herein, hyperlinked and anywhere within this website. The Terms of Service and Terms of Use (“Terms”) describe our commitments to you, and your rights and responsibilities when using our services. Please read them carefully and reach out to us if you have any questions. The Terms apply to all users of the site, including without limitation users who are browsers, vendors, customers, merchants, and/ or contributors of content. 

By visiting our Website and/or purchasing from us, you agree to be bound by our Terms & Conditions and Privacy Policy outlined within the Website. If you do not agree to all the terms and conditions of this agreement, you may not access the Website or use any services.

We reserve the right to update, change or replace any part of the Terms by posting updates and/or changes to our Website. It is your responsibility to check this page periodically for changes. Product Availability

All products listed on the website are subject to availability. Kooloo will not be liable for any products that are not available at the time of your checkout. In instances of website malfunction, technical issues, or incorrect price display, your order will be terminated. We will notify the customer for any changes to their order and refund the payment amount accordingly.

You acknowledge that products that are advertised or displayed on the website may not be available to purchase at the time you access the website.

Please note the products image displayed on the website may differ in colour from the actual product. We do not guarantee that the product colour will be accurate to the one shown on the website.

All descriptions of products and product pricing are subject to change anytime without notice at our sole discretion. We reserve the right to discontinue any product at any time. Any offer for any product or service made on this site is void where prohibited.

We do not warrant that the quality of any products purchased, or information obtained by you will meet your expectations, or that any errors in the service will be corrected.

 

Taxes Duties and/or Custom Fees

All the product prices listed within the website are in Australian Dollars (AUD) and include applicable Goods and Services Tax (GST).

There may be taxes or duties applied by customs towards your order when, or after delivery is made. Please know these charges are not inclusive of the original shipping charge and are unable to be paid for or reimbursed by Kooloo. 

If you do not pay your customs fees your order may be destroyed/abandoned, and we are unable to provide any reimbursement for your order. It is the customers responsibility to contact the relevant customs office to find if you are affected by these charges.  

 

Information Policy

You acknowledge that we are not responsible if any information or product description provided on this website is not accurate, complete, or current. The material made available on the website is for general information only and should not be taken as face value or used as the sole basis of truth for decision making. Any reliance on the material on this website is at your own risk. We reserve the right to modify the contents of this website at any time but are under no obligation to update any information on the website. You agree that it is your responsibility to monitor changes to our website.

Kooloo does not warranty that the Website or products will meet your user requirements/expectations or that the information contained on the Website, or your use of the Website will be uninterrupted, timely, secure, error-free, accurate, virus-free, or compliant with legislation or regulations. 

You acknowledge and agree that Kooloo has no liability of any kind either express or implied with respect to any claims arising in any way from your use of the Website, by virtue of the information provided or contained on the Website.

You acknowledge that you are responsible for ensuring the protection of your electronic equipment when accessing or browsing the Website and unreservedly hold Kooloo harmless in respect to damage sustained to your electronic equipment or losses incurred by you as a result of the Website.

Kooloo is not held responsible in any way for damages to your mobile phone when using a Kooloo phone case.

The Kooloo phone cases have a rope which can be potentially dangerous for children and adults. Kooloo is not held responsible in any way for injuries or death connected with the use of the Kooloo phone case. Kooloo is not held responsible in any way for damages to objects connected with the use of a Kooloo phone case.

 

Indemnification and Severability

You agree to indemnify, defend and hold harmless Kooloo and our, subsidiaries, affiliates, partners, officers, directors, agents, contractors, licensors, service providers, subcontractors, suppliers, interns and employees, harmless from any claim or demand, including reasonable attorneys’ fees, made by any third-party due to or arising out of your breach of the Terms or the documents they incorporate by reference, or your violation of any law or the rights of a third-party.

If any part of the Terms is held to be illegal or unenforceable, you authorise Unik Case to amend or sever that part of the Terms to make that part legal and enforceable or to ensure that the remaining parts of the Terms remain in full force and effect.

You acknowledge that Kooloo may vary the Terms and you agree to be bound by that variation from that time when that variation is advised. You understand that it is your responsibility to regularly check the Terms so that you are aware of any variations which apply. Your continued use of the Website constitutes your agreement to the Terms and any variations to the Terms.

 

Use of Website

You acknowledge that you are using this website at your own risk, and you unreservedly indemnify Kooloo from any responsibility with regards to information or content listed on the Website.

You agree not to engage in any activity that is disruptive or is detrimental to the operation of function of the Website. You are prohibited from positing or transmitting unlawful, threatening, defamatory, obscene, or profane material on the Website. Kooloo, at our sole discretion and opinion, reserves the right to prevent you from accessing the website and using the Services provided by Kooloo if you have violated or acted inconsistently with the Terms.

You further agree that your comments will not contain libellous or otherwise unlawful, abusive or obscene material, or contain any computer virus or other malware that could in any way affect the operation of the Service or any related website. You may not use a false e‑mail address, pretend to be someone other than yourself, or otherwise mislead us or third parties as to the origin of any comments. You are solely responsible for any comments you make and their accuracy. We take no responsibility and assume no liability for any comments posted by you or any third-party. 

Disclaimer

We do not have any affiliation with any other businesses labelled Kooloo internationally. We are a small business registered and operating in Australia (ABN 58650617520). Our case designs are not affiliated with nor in collaboration with any other brands or companies and are only added for artistic expression purposes.

Refund Policy

We do not accept exchange or refund goods due to change of mind. If you wish to do so, this must be done within 1 hour of order placement by contacting us on Customer-service@kooloo.com.au or filling out our contact form.

 

Damaged Phone Case

If you receive damaged goods or a different model / color than the one you ordered, please get in touch with us as soon as possible.

We understand that the product may be damaged during transportation. Please send us a photo of the product when you receive it, and a replacement will be sent to you at no extra cost if your claim is credible. We, in our sole discretion, reserve the right to decline any request for refund/return/exchange based on our assessment of the claim. Please note that whilst we strive to provide the highest quality phone cases, we do not guarantee to prevent all damage to your device.

If you received the wrong color / model, please contact us as soon as possible, send us a photo and we'll replace it at no extra cost.

This Privacy Policy tells you how we access, collect, use and share your personal information when you visit or make a purchase from our website, and inform you about your rights and consent.

We collect some information about you when you make a purchase or attempt to make a purchase from our website. Termed as ‘Order Information’, these are inclusive of your name, billing address, shipping address, payment information which includes your credit card details, email address, and phone number.

Cookies help you store your personal information inclusive of your name, email address and website access, at your discretion, when you login, make or attempt to make a purchase, or leave a comment on our website.

Note that when you login, we automatically set a temporary cookie on your browser. This cookie stores no personal information and is removed automatically when you close your browser. We will also set up several cookies to save your login details, which lasts for two days. If you select ‘Remember Me’ option during login, your details will last for two weeks. The login cookies will be removed whenever you logout of the website account.

The Order Information we collect is used to fulfil your orders – provide you with the order confirmation, invoice and order delivery updates, processing your payment and arranging for shipping.

Whilst the order information is mainly used for order placement and communicating with you, we may also use it to screen for potential fraud or other risks posed during order placement. We may also use it to improve and optimise our website and advertising campaigns.

With your consent and in line with your preferences shared with us, we may use your personal information for marketing and advertising purposes relating to our products and services. Who do we share your data with?

We may disclose your personal information if we are required to do so by law or if you violate our Terms or to protect our rights.

We share your Personal Information with third parties listed below for purposes mentioned in the section above.

Shopify: Our store is powered by Shopify which enables us to sell our products and services to you. Your data is stored through Shopify on a secure server behind a firewall. If you have provided your credit card details for purchase on our website, your credit card data is temporary stored by Shopify and complies with the Payment Card Industry Data Security Standard (PCI DSS) and encryption. Your purchase transaction data is stored only for the time necessary to complete the payment transaction. After the payment process is complete, your purchase transaction information is deleted.

Google Analytics: We use Google Analytics to help us understand our customers which in turn helps us enhance user experience, place and manage advertisements, market our products and analyse the effectiveness of our marketing. Third Party Vendors: We share information about you with third-party vendors who need the information in order to provide their services to us, such as payment providers that process your credit and debit card information, fraud prevention services, cloud storage services, postal and email delivery services, customer support services that help us communicate with you, customer relationship management (CRM) tool providers and third party tools that help us manage operations. We recommend you visit the privacy policies of these providers for you to understand how they use your personal information. If you would like further information, we are able to provide individual provider details at your request. When you make a purchase or attempt to make a purchase from our website we will maintain your Order Information for our records, until and unless you ask us to delete your personal information.

We do not alter our data collection and use practices when we see a ‘Do Not Track’ signal from your browser.

 

Advertising Just for You

When you provide us with personal information whilst placing an order for purchase transaction, payment processing, package shipping, we imply that you consent to Kooloo collecting and using your personal information for that specific purpose only. We will specifically ask for your expressed consent to use your personal information for marketing purposes. With your consent, we may send you emails and newsletters about our store, new products, promotions and any other updates. You can unsubscribe from our marketing campaign at any time.

Shipping Policy

Shipping Details: We provide free standard shipping within Australia. Your orders will be processed within 48 hours (Monday to Friday), please allow 3-6 business days for delivery. You can opt for an express delivery with an extra $6.99, expected delivery 1-3 business days.

Entered Wrong Address: If you have entered the wrong postage address, please get in touch with us as soon as possible. We process your orders within 48 hours of order placement; once it has been sent for delivery, we are unable to change the delivery address for you. Please use your tracking number for the package and contact the shipping company for assistance with delivering to the correct address or by re-directing to the correct address via the postage tracking platform.

Kooloo is not responsible for orders that are not delivered when you have entered incorrect delivery address.

Did not receive my package: We provide tracking details for your package. If your tracking information states that the package was delivered but you have not received it, the onus is on you to address this with your local post office or the shipping company. Kooloo does not hold responsibility for orders when the shipping tracking deem it as delivered, therefore we would not issue a refund for packages not received by the customer. Kooloo will not be held responsible for any theft or damage if your parcel is left at an unattended address.
